Yes, in California it is a misdemeanor. But if someone is injured or dies as a result of emergency service response to a false call, it is a felony, with a possible sentence of a year or more in jail.1Cal Penal Code 148.3
2. Is it illegal to buy or use a flamethrower?
In California you can buy and use a flamethrower that shoots flames a distance of less than 10 feet, no permit or anything required. For flamethrowers that shoot at least 10 feet, you must get a permit.2Health & Safety Code Sec 12750-12761 State lawmakers are considering additional regulations on flamethrowers that shoot less than 10 feet.
